Terms of Use

These Terms of Use ("Terms") govern your access to and use of the website, mobile application, and services (collectively, the "Platform") provided by Bamboo Hospitality Travel Sdn. Bhd. (formerly known as Bamboo Hospitality Platform Sdn. Bhd.) (trading as JOMhotel) ("we", "us", or "our"). By accessing or using our Platform, you agree to be bound by these Terms.

  1. Scope of Our Services
    1. JOMhotel is an online travel agency (OTA) that enables users to search, compare, and book accommodation services provided by third-party hotels, resorts, and properties ("properties").
    2. We act solely as an intermediary between you and the property. The contract for accommodation is between you and the property, not JOMhotel.
    3. We do not own, manage, or control the property's services.
  2. User Obligations
    1. You must provide complete, accurate, and up-to-date information when making a booking on the Platform. This includes, but is not limited to, guest names, contact details, and payment information.
    2. Guest information must be written accurately, as some properties may refuse check-in if the details provided (e.g., guest name) do not match the identification documents presented at the property.
    3. JOMhotel will take reasonable steps to remind you of the importance of providing correct information. However, JOMhotel shall not be held liable in the event a property denies check-in, cancels a booking, or imposes additional charges due to inaccurate or incomplete information provided by you.
    4. You must be at least 18 years old to register an account, make a booking, or use the Platform. By using the Platform, you represent and warrant that you are 18 years of age or older.
    5. The minimum age for check-in is determined by each property. Certain properties may require guests to be above 18 years old to check in, or may require parental or guardian accompaniment for younger guests. You are responsible for verifying and complying with the relevant property's age requirements.
    6. JOMhotel shall not be liable if you or any guest is denied check-in due to failure to meet the property's age policy.
  3. Booking and Payment
    1. By completing a booking through our Platform, you agree to our terms and conditions, including cancellation, amendment, refund, and no-show policies. Please ensure that all guest information, especially names, is entered accurately at the time of booking, as some hotels may refuse check-in if the guest's name does not match their identification. While JOMhotel will remind you to double-check the details, we cannot be held responsible if check-in is denied due to inaccuracies provided by you.
    2. Prices displayed on the Platform include Sales and Service Tax (SST) where applicable. However, other taxes, fees, or charges may not be included in the displayed price. Additional charges may apply depending on the circumstances, such as the Tourism Tax (for non-Malaysian guests), heritage tax, city tax, or other levies imposed by the hotel or local authorities. These charges, if applicable, are payable directly by the guest at the property.
    3. Payment alone does not guarantee a confirmed booking. A booking is only valid once you receive a confirmation from us. In rare cases, your payment may be processed but the booking cannot be completed—for example, when two customers attempt to book the last available room at the same time through different platforms, and another booking is confirmed first. In such cases, JOMhotel will either assist in arranging a nearby hotel of similar pricing or issue a refund, at your option. Any refund provided will be limited to the original amount paid.
    4. Users shall not use an invalid bank card or account, or any bank card or account that they are not duly authorised to use when making payments on the Platform.
    5. All payments on the Platform will be processed in Malaysian Ringgit (MYR). If you choose to pay using a foreign currency, you are responsible for checking the applicable exchange rate with your payment provider. Please note that your payment provider may also charge additional fees for international transactions or currency conversion, and JOMhotel has no control over or liability for such charges.
  4. Cancellations, Refunds, and Changes
    1. All bookings made through the Platform are non-cancellable, non-modifiable, and non-refundable, except in exceptional cases where the failure arises from issues attributable to the Platform itself (such as confirmed booking errors or payment processing faults)
    2. JOMhotel is not liable for any refusal of refund, amendment, or compensation—including in situations where a guest is refused check-in due to incorrect booking details (such as mismatched name or identification). It is the guest's sole responsibility to ensure accuracy when making a reservation.
  5. User Content
    1. All bookings made through the Platform are non-cancellable, non-modifiable, and non-refundable, except in exceptional cases where the failure arises from issues attributable to the Platform itself (such as confirmed booking errors or payment processing faults)
    2. JOMhotel is not liable for any refusal of refund, amendment, or compensation—including in situations where a guest is refused check-in due to incorrect booking details (such as mismatched name or identification). It is the guest's sole responsibility to ensure accuracy when making a reservation.
  6. Prohibited Uses

    You may only use the Platform for lawful purposes. Without limitation, you agree that you will not use the Platform or its services:

    • In any way that breaches any applicable local, national, or international law or regulation.
    • In any way that is unlawful, fraudulent, unauthorised, or abusive, or that has any unlawful, fraudulent, unauthorised, or abusive purpose or effect.
    • For the purpose of harming or attempting to harm minors in any way.
    • To send, knowingly receive, upload, download, use, or re-use any material that does not comply with our content standards.
    • To transmit, or procure the sending of, any unsolicited or unauthorised advertising, promotional material, or any other form of solicitation (spam).
    • To knowingly transmit or upload any material that contains viruses, trojan horses, worms, time bombs, spyware, adware, keystroke loggers, or any other malicious or harmful code or program designed to disrupt or damage software, hardware, or data.

    You further agree:

    • Not to reproduce, duplicate, copy, sell, resell, or exploit any part of the Platform in contravention of these Terms.
    • Not to access without authority, interfere with, damage, or disrupt:
      • any part of the Platform;
      • any server, equipment, or network on which the Platform is hosted;
      • any software used in the operation of the Platform; or
      • any server, equipment, network, or software owned or used by a third party.
    • Not to interfere with or attempt to interfere with the normal operation of the Platform or any activity conducted through it.
    • Not to take any action that imposes, or may impose, an unreasonable or disproportionately large load on the Platform's infrastructure.
  7. Limitation of Liability
    1. JOMhotel acts solely as an online platform facilitating the booking of accommodation services provided by independent properties. We do not own, operate, or control the properties listed on our Platform.
    2. While we make reasonable efforts to ensure that information displayed on the Platform is accurate, we are not liable for:
      • any inaccuracies, errors, or omissions in the information provided by properties (including descriptions, availability, facilities, pricing, or policies);
      • any failure, interruption, or delay in the delivery of services by properties; or
      • any loss, damage, claim, or expense arising from or related to services provided by properties.
    3. In the event of service issues or discrepancies with a property, JOMhotel will assist you to achieve a resolution, but we do not guarantee a particular outcome or resolution.
    4. To the fullest extent permitted by law, JOMhotel disclaims all liability for any indirect, incidental, consequential, or punitive damages arising from the use of the Platform or services provided by properties.
    5. In any event, JOMhotel's total aggregate liability arising out of or in connection with your use of the Platform or services shall be limited to the total booking amount paid by you through the Platform for the specific booking giving rise to the claim.
  8. Intellectual Property Rights
    1. Unless otherwise stated, all rights in and to the Platform (including but not limited to technology, software, content, design, trademarks, trade names, layout, and overall "look and feel") are owned by JOMhotel (Bamboo Hospitality Travel Sdn. Bhd. (formerly known as Bamboo Hospitality Platform Sdn. Bhd.) or its licensors. By using the Platform, you agree to do so only for its intended purpose and in compliance with these Terms.
    2. You are not permitted to monitor, copy, scrape, crawl, download, reproduce, or otherwise use any part of the Platform (including its content, pricing, or data) for any commercial purpose without prior written consent from JOMhotel or its licensors.
    3. JOMhotel reserves the right to monitor activity on the Platform and block any user (or automated system) that we reasonably suspect of:
      • conducting an excessive or unreasonable number of searches;
      • using devices, bots, or software to collect prices, availability, or other information; or
      • engaging in any activity that places undue stress on the Platform's systems or infrastructure.
    4. By uploading, submitting, or posting any content (including reviews, photos, or feedback) on the Platform, you confirm that such content:
      • is truthful and accurate (e.g., you have not altered photos or misrepresented information);
      • does not contain any viruses, malware, or harmful code;
      • is lawful and does not infringe the rights of third parties;
      • is owned by you, or you have obtained all necessary rights and permissions to share it; and
      • grants JOMhotel a worldwide, royalty-free, non-exclusive license to use, reproduce, distribute, display, and adapt such content on the Platform and in other media for commercial purposes (including marketing and advertising), unless you request us in writing to stop using it.
    5. You remain solely responsible for the content you provide and agree to indemnify JOMhotel against any legal claims, liabilities, or damages arising in connection with such content. JOMhotel is not responsible or liable for any content uploaded by users and reserves the right to remove or edit any content at its sole discretion (for example, if it does not meet our standards).
  9. Suspension, Termination & Right to Cancel
    1. JOMhotel reserves the right, at its sole discretion, to suspend or terminate your access to the Platform, or to cancel any booking made through the Platform, if you are found to be in breach of these Terms of Use, applicable laws, or the rights of JOMhotel, properties, or other users.
    2. In such cases, JOMhotel shall not be liable for any direct or indirect losses you may incur as a result of such suspension, termination, or cancellation. Any refunds (if applicable) will be determined in accordance with these Terms and the policies of the relevant property.
    3. JOMhotel also reserves the right to take legal action in the event of fraudulent, abusive, or unlawful activity, including but not limited to misuse of payment methods, provision of false information, or attempts to interfere with the normal operation of the Platform.
  10. Indemnity
    1. JOMhotel strives to provide you with the best possible services. However, we cannot guarantee the accuracy, completeness, or reliability of all information on the Platform, particularly where such information is provided directly by properties.
    2. If we are made aware of any inaccuracies or errors, we will take reasonable steps to verify and actively correct the information.
    3. You agree to indemnify, defend, and hold harmless JOMhotel, its affiliates, officers, employees, and agents from and against any claims, demands, losses, damages, liabilities, costs, or expenses (including reasonable legal fees) arising out of or in connection with:
      • your breach of these Terms;
      • your misuse of the Platform;
      • any claim made against JOMhotel by any property, authority, or other third party due to information, actions, or omissions attributable to you (including but not limited to inaccurate guest details, fraudulent use of payment methods, or unlawful conduct).
    4. This indemnity obligation shall survive the termination of your account, cancellation or completion of a booking, and your use of the Platform.
  11. Governing Law and Dispute Resolution
    1. These Terms are governed by the laws of Malaysia.
    2. Any disputes arising shall be subject to the exclusive jurisdiction of the courts of Malaysia.
  12. Changes to Terms
    1. We may update or modify these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
